The
following Terms and Conditions apply to subscribers of Anngel.com.
Multiple
simultaneous access is not permitted.
Clients
may not resell access through their Anngel Internet account.
Payment
Policies
All accounts are set up on a pre-pay basis. Setup fees are
charged for all new accounts and are non-refundable. (An exception
is made for persons switching from another ISP, who present
a valid copy of an invoivce from their previous ISP. This
invoice cannot be more than 3 months old).
All pricing is guaranteed for the term of pre-payment. Ankhs
reserves the right to change prices at any time, unless other
terms have been agreed upon. Any account not brought current
within four (4) days of e-mail notice or exceeding this time
frame in any way is subject to suspension. The customer is
responsible for all money owed on the account from the time
it was established to the
time that the customer notifies Ankhs to request for termination
of services. All terminated accounts will attract a re-connection
fee to be re-instated.
Ankhs accounts are setup on two billing cycles - Cycle
A and Cycle B (read).
Your particular billing cycle corresponds to the contract
length that was initially chosen at setup. Your account will
automatically renew at this length. Should a customer request
a change in billing cycle, prior notification must be given
to Ankhs. Change in cycles will incur an additional cost which
is equivalent to a half-month's access. Ankhs is not obligated
to credit time to any account requesting changes in cycles.
Payments
are accepted via several methods including direct payment
at our offices in Kingston, St. Catherine and Montego Bay,
as well as through bill collection agencies Bill Express,
Paymaster and Telescotia Tele-banking. Payments may be made
using cash, cheques, debit and credit card deductions.
Credit
Card Customers will have to make arrangements to make their
first payment at our offices and give authorization for automatic
payments when they become due. Any changes in this arrangement
must be made in writing with at least two weeks notice.
Indemnification
CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND
HOLD Ankhs HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES,
LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY'S
FEES ASSERTED AGAINST Ankhs, ITS AGENTS, ITS CUSTOMERS, OFFICERS
AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED
OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD
BY CUSTOMER, IT'S
AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY
AND HOLD HARMLESS Ankhs AGAINST LIABILITIES ARISING OUT OF;

ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS
SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH Ankhs'
SERVER;
-
ANY MATERIAL SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY
INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY;

COPYRIGHT INFRINGEMENT AND
-
ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM Ankhs' SERVER.

Ankhs Limited WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR
BUSINESS MAY SUFFER. Ankhs MAKES NO WARRANTIES OF ANY KIND,
EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. Ankhs DISCLAIMS
ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS,
NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS
CAUSED BY Ankhs AND ITS EMPLOYEES. Ankhs RESERVES THE RIGHT
TO REVISE ITS POLICIES AT ANY TIME.
BILLING
CYCLES
Billing
Cycle A
All
customers due for payment between the 1st and the 15th of
each month will be required to make payment on the 15th and
no later than the 19th of the month at our offices or authorized
outlets.
Billing
Cycle B
All
customers due for payment between the 16th and the 31st of
each month will be required to make payment on the 30th and
no later than the 4th of the following month at our offices
or authorized outlets.
Please
note that nonpayment of subscription fees by the dates specified
will results in the disconnection of your Internet service
which will attract a cost of $575.00 to be re-established.
Acceptable
Use Policy
The
following is the Acceptable Use Policy (AUP) in order to protect
our customers and help protect the Internet Community in general.
While this AUP is not carved in stone, abuse of the AUP will
be viewed in a much more severe light than minor violations.
E-Mail
Commercial
E-mail:
Sending unsolicited commercial e-mail
(UCE), also called SPAM, is prohibited. Using your Anngel
account to collect responses from any UCE or SPAM is also
prohibited.
Mail
Bombing, Harassment, etc.:
Sending large amounts of e-mail to the
same recipient, also called mail bombing is prohibited. Additionally,
sending abusive, threatening, or otherwise harassing e-mail
after being asked to cease by the recipient is also prohibited.
Sending extremely threatening or harassing e-mail is always
prohibited.
UseNet
News
Spamming
or Crossposting:
Posting the same article multiple times,
or across multiple groups in excess is called SPAMMING. Spamming
of News Groups is prohibited. The general rule is to post
a single article to no more than 15 different groups.
Off-Topic
Posts:
Typically, there is no restriction on
the content of a UseNet post, other than the guidelines set
for each individual group. Please adhere to each news group's
policy. Blatant violation of a group's policy is prohibited.
General
Network
Damaging Activity:
Any activity that may cause problems
along the Anngel Network, and/or inhibit the ability of other
Anngel users to use the Anngel Network or the Internet is
strictly prohibited.
Interfering with or disrupting the Service -- or servers,
computer systems, or networks connected to the Service --
or interfering with another user's use and enjoyment of the
Service, including but not limited to (a) transmitting any
material that contains viruses, trojan horses, worms, time
bombs, cancelbots, or any other harmful or deleterious programs,
or (b) attempting to gain unauthorized access to the Service,
other's accounts on the Service, or private mailing lists
on the Service through password mining or any other means;
Impersonation:
Attempting to impersonate the identity
of another person on the Internet by using forged e-mail or
news headers, or other identifying information is prohibited.
The use of anonymous remailers and anonymous news posters
does not constitute Impersonation.
Privacy:
Any attempts to gain access to a computer
system or customer's data without consent, whether successful
or not, is strictly prohibited.
Using
the service for illegal purposes or for posting material that
is unlawful, harassing, abusive, threatening, harmful, vulgar,
obscene, tortuous, libelous, invasive of another's privacy,
or otherwise objectionable, including but not limited to material
that contains blatant expressions of bigotry, prejudice, racism,
hatred, or profanity, or that promotes or provides instructional
information about illegal activities or promotes physical
harm or injury against any group or individual;
Copyright
Infrigement:
Violating
the rights of third parties, including but not limited to
rights of publicity, copyright, trademark, patent, trade secret
and other intellectual property rights;
Harvesting or otherwise collecting information about others,
including e-mail addresses, without their consent;
Providing
false information on your registration form, or attempting
to mislead others as to the identity of the sender or the
origin of a message;
Distributing content that consists of hyperlinks to sites
that contain content not allowed on the Service;
Engaging in any conduct which constitutes your promoting the
commercial interests of yourself or any third party; or,
Engaging in any other conduct in which Ankhs, in its sole
discretion, believes is improper.
TERMINATION:
Any misuse of the Service, as determined solely by Ankhs,
will cause termination and your removal from our services.
Ankhs reserves the right to terminate your service at any
time and effective immediately, without prior notice.
